Entering a legally binding contract

1. Once you make any form of payment for our courses, whether it is a deposit or the full course fee, it is deemed as an offer by you to enter into a legal contract with us.

1.1 You and Us will only enter into a binding contract when you receive notification from us that we accepted your order. Once we accept your order, a binding contract between you and us will come into being subject to these Terms and Conditions.

1.2 You should keep a copy of these terms and conditions for your records. If you have any questions, please ask us.

Right to cancel

2. We provide beauty training courses which include both theory and practical training. The following right to cancel terms are set out in accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2.1 The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 permits consumer customers to cancel a contract after it is has been entered into subject to certain limitations and requirements. You have the right to cancel the contract at the end of 14 days, after the day the contract is entered in to. However, if the course is booked and delivered within these 14 days then the same “right to cancel” does not apply

2.2 If you have the right to cancel then the below procedures must be followed:

· You will need to e-mail Us on info@handsonbeautyschool.co.uk stating that you wish to cancel the contract between us and you

· You will need to send us the notice of cancellation within the 14 period starting with the day after you receive our confirmation that there is a binding contract between you and us;

· After we receive your notice of cancellation, you will then be refunded within 30 working days to the same payment method that the course was purchased. We reserve the right to refuse any requests for refunds to be made via any alternative method to the original purchase.

Services provided

3. Once You and Us have entered into a legally binding contract, we will provide you with the appropriate course materials via e-mail and then any necessary materials during the practical training sessions on the dates and times stated on the booking confirmation.

3.1 Minimum age requirement for booking with our accreditor company is 16 years old. Please note some other insurance companies may ask a minimum of 18 years old.

Deposits

4. A small deposit is required to secure your place on the course. You will then receive a booking confirmation e-mail to confirm your date and time.

4.1 Course fees must be paid in full prior to course commencement.

4.2 Our admin team are able to provide you with our bank details for BACS payment. We also accept cash payments, however you will be required to confirm your course in person at our head office in Giltbrook

4.3 Should you be purchasing any available course using a gift voucher or discount code, you must ensure this is applied at the time of making payment as this cannot be applied at a later date. Please note, We reserve the right to amend / change / run promotions at any given time, without prior notice. Should any course be discounted at a later date, You cannot request for the difference to be refunded.

4.4 Should you book a combined course (discounted), you will be expected to make payment in full in order to qualify for the discount.

4.5 The named person(s) on the booking confirmation is the person(s) that will be on the attendance register. Booking confirmations cannot be transferred to any other person(s). Should any student attempt to send a person(s) in place of them, there will be an admin charge of £25.00 per person. Should the named person not wish to continue with the course and have an alternative person(s) to take their place, We must be informed in order to make register changes and 48 hours’ notice must be provided in writing.

Refunds/ Cancellations

5. All Course fees are non-refundable and non-transferable.

5.1 We will not offer any refunds for conditions beyond our control. For example, adverse weather conditions, flooding, student visa refusals, transport issues. Alternative training dates will be offered in any such event. Should there be any future lock-downs, course fees will remain and courses will be rescheduled to which You will receive e-mail communication of when such course dates can be scheduled.

5.2 We will not be responsible for any loss of income / accommodation / travelling costs due to a rescheduling of course dates.

5.3 Should You wish to cancel any course, and there is a legitimate reason(s), you agree that you will provide proof at the request of Hands On Beauty School. The same rulings apply should you wish to reschedule a booked course, at Our discretion. Should either of these requests be successful, they will incur an administration fee of £25.00 per cancellation/transfer.

5.4 Should You be unable to attend any course due to medical reasons, you will be required to show a valid medical certifications and all fees will be waivered. Should a valid medical certificate not be required/unable to obtain, it is at Our discretion as to whether the course fee will be refunded/rescheduled.

Practical Training / Assessments

6. Practical training & assessments will take place on the date, time and location as specified in your booking confirmation e-mail.

6.1 You are required to be at the practical training location 15 minutes prior to the stated commencement time.

6.2 All course timings are listed on the email sent to you. You will be given a short break for lunch. You must ensure you stay local to the training centre, any late returns from break, may result in you being refused entry back onto the course and you will forfeit course fees.

6.3 On successful completion of your course, you will be awarded with an accredited in-house certification. With this certificate you will be able to gain insurance.

Course Obligations prior & during the course

Before the practical training

7. Once you have booked your course by paying a non-refundable deposit, you will receive a confirmation e-mail confirming the amount paid, the title of the booked course and the chosen course date.

During the practical training

7.1 During the course you must, at all times:

1. Act and behave appropriately. Abuse or antisocial behaviour towards either our trainers or other students will not be tolerated and you will be removed immediately from the course.

2. Dress appropriately in smart, comfortable clothing. Tunics may be worn or alternatively black trousers and a black t-shirt may be worn.

3. Ensure that your hair is tied away from your face.

The terms of this section are necessary for the health and safety of our staff and other students. Failure to comply with the terms in this section will be a breach of this agreement and may lead to your expulsion from the course.

7.2 You will be required to work on your chosen model that we supply and arrange the correct times for them to come to the office in Giltbrook, if you are not able to get a mode you MUST let us know at info@handsonbeautyschool.co.uk at least 1 week before your course so we can then sort a model.

Certifications

8. Subject to the Course fees due being paid in full, Course certificates will be available on the same date of successfully completing the course. We cannot be responsible for any mistakes made on the certificate which are a result of incorrect details being provided by You when booking either online / or via the printed booking form. You are encouraged to double check these details following your booking.

8.1 Certificates must be sent to info@handsonbeautyschool.co.uk prior to the course for anyone taking our refreshers course. This will be for Hands On Beauty Schools insurance purposes and to also confirm you are already qualified in the chosen courses you wish to refresh.

Code of conduct

9. Arrive 15 minutes prior to course commence time. This allows the course to start on time without any disruptions. It will also allow time for any student to make their final payment if they have only paid a deposit.

9.1 Should any student have any medical conditions or learning difficulties, you must inform us at the time of booking in order for the relevant tutor to be informed. This will allow the tutor to support the student throughout the day.

9.2 We request that you do not bring personal belongings with you. Hands On Beauty School will not accept any responsibility for any loss / damage / misplaced / theft of students personal belongings. Should any students’ property be left at the training centre, we will hold onto the property for a period of 5 working days, and contact the student (should this be clear of whom the property belongs to). Failure to collect your belongings, will result in Us disposing of the items.

9.3 All students are requested to stay local to the training centre / stay on site and bring a packed lunch with you. You will be given set breaks by the tutor and must arrive back to the training location on the time stated. Should you be late returning to the course, you may be refused entry, fail to complete your course and will not be offered any refunded.

9.4 All practical course equipment will be provided by Us. All products and tools remain the property of Hands On Beauty School, and should any of these items be taken, this will be treated as theft and reported to the appropriate authorities. All students must take care when using our products, and any negligence may result in students being held responsible for any costs of such loss / damage. Students must not, at any time, attempt to access staff store cupboards / storage areas.

9.5 Use of mobile phones are strictly prohibited during training sessions and must be switched off / silenced during class.

9.6 Smoking / e-cigarettes / vaporisers / chewing gum is forbidden within the training centre.

9.7 Students must not consume or be under the influence of alcohol or drugs. Should this be the case, you will be asked to leave the centre immediately.

9.8 For health and safety reasons, children are not permitted at the practical training venues.

9.9 Hands On Beauty School operate an equal opportunities policy. All students must be respectful at all times, of the tutors and other students. Verbal, physical , written abuse/ sexism/ageism/ sensitive topics that may cause offence to others / racism / inappropriate language/ behaviour will not be tolerated and you will be asked to leave the centre and will not be allowed to book any further courses.

10. Students will not be allowed to take any photographs / recordings/ videos of any kind whilst in the practical training room. This is to protect the privacy of other students and avoid any distribution during sessions. They tutor may take some photos, with the permission of the students, for our social media / marketing purposes only.

10.1 We will keep all student/customer personal information private and confidential and filled in accordance with GDPR Rules and Regulations

10.2 We will not be responsible for any e-mails that students fail to open / read on time which may relate to course confirmation, patch testing, course cancellation, or course changes. Should you not receive your course booking confirmation e-mail after 24 hours from making a payment, you must contact us. All students are expected to check any junk / spam folders prior to contacting us.

Kits & Products purchase terms

11. Hands On Beauty School offers students the opportunity to purchase their starter kits from us to make their transition from course to real clients easier without the worry of where to purchase products from.

11.1 Hands On Beauty School will not be responsible for damage or injury resulting from misuse of these products.

11.2 Hands On Beauty School do not except any refunds or return on the kits

Intellectual property

12. All design, text, graphics, images, content and other intellectual property contained in any of the course materials, videos and manuals are, unless otherwise stated, the intellectual property of Hands On Beauty School. Any reproduction, modification, or other unlawful use of our intellectual property is strictly prohibited and may result in legal action being taken against you. All materials must not be reproduced in any form.

Amendments to the contract terms & conditions

14. We have the right to amend the terms and conditions of this contract where:

14.1 It is a mandatory requirement in order to comply with changes in the law or for regulatory reasons; or

15.1 We need to correct any errors or omissions, as long such correction is minor and does not materially affect the contract. Where we are making any amendment we will inform you at any stage.
